News: Hail to the judge, baby!
Bloomberg is reporting that Take-Two has sued 3D Realms (AKA Apogee Software Ltd) over their failure to finish Duke Nukem Forever. Take-Two is citing a breach of contract as the company paid $12 million in 2000 for the publishing rights to the game:
УApogee continually delayed the completion date for the Duke Nukem Forever,Ф Take-Two said in the complaint. УApogee repeatedly assured Take-Two and the video-gaming community that it was diligently working toward competing development of the PC Version of the Duke Nukem Forever.Ф
Take-Two and 3D Realms reached a second agreement in 2007 after Duke Nukem Forever reached its tenth anniversary of development.

New York State Supreme Court website.
I guess this puts an end to the conspiracy theories that Duke Nukem Forever was actually done and all of this bankruptcy business was the start of some kind of marketing campaign.
